“Contention 1: a federal FTC framework reduces deceptive promos and predatory marketing that drive addiction. Deceptive promos are a documented problem. Reuters explains how ‘risk-free’ offers often refund losses with non-withdrawable bonus credits and extra conditions… Meanwhile, the FTC’s core rule for advertising is straightforward: the claim must be truthful and not deceptive. A federal framework can set clear, enforceable standards for sportsbook ads and promote disclosures nationwide… Gambling disorder now sits in the same diagnostic category as substance use disorders… A 2025 U.S. News and World Report survey found nearly one in four bettors missed bill payments due to gambling, 30% went into debt because of sports betting…”
2. 解决各州法规“拼凑”问题,防止监管套利

“Contention 2: a federal FTC framework fixes the patchwork problem that bad actors exploit. Sports betting is legalized state by state, but the consumer harms are national. Apps, ads, and data flows cross borders. Patchwork rules invite loopholes and uneven enforcement… The impact: without consistent national standards, companies can push the most aggressive ad tactics and promos designed for the weakest rule states, while consumers everywhere are exposed through national broadcast media.”

1. 侵犯州权,违背联邦主义原则
当前州级监管体系源于最高法院2018年对“墨菲诉NCAA案”的裁决,该裁决确认监管赌博的权力属于各州。联邦统一框架是对州权的践踏,忽视了各州在经济、文化和道德观上的差异。

“Contention one: States' rights and federal overreach. The foundational problem with the resolution is that it tramples established principles of federalism and states' rights… The court held that the federal government cannot force states how to regulate sports gambling. States retain authority absent explicit congressional delegation… Federal regulation under the FTC would override this autonomy, forcing a one-size-fits-all regime that undermines democratic governance at the state level.”
2. 联邦贸易委员会缺乏专业能力,且将助推黑市

“Contention 2: FTC fails. The FTC's mandate focuses on consumer Protection and antitrust, not on specializing in gaming regulation. Sports betting involves complex issues such as age verification, gaming integrity, anti-money laundering, geolocation enforcement… State gaming commissions are better equipped at handling all of these issues.”
“Contention 3: black market activities… Research in gambling markets shows that even well-intentioned regulation does not automatically eliminate illegal betting… The reason is simple: if federal rules make legal betting more burdensome… illegal operators with lower overhead can offer better odds and easier access. This dynamic undermines the very consumer Protection goals that proponents of federal regulation claim to champion.”
